Terms and conditions of Twisting Cat

1. Company presentation

These terms and conditions describe the rights and obligations of Renaud Glotz, creator and representative of the Twisting Cat brand, registered under the number BE 0689.777.787 and accessible via the e-mail address info.twistingcat@gmail.com.

For all official inquiries, including complaints, please use this contact point. The company complies with all current legal requirements concerning e-commerce and consumer protection.

2. Scope of Application and Acceptance of the GTS

These terms and conditions apply to all sales concluded between Twisting Cat and its customers via the online sales site. By validating an order, the customer confirms that he/she has read and accepted these terms and conditions without reservation. In the absence of express acceptance by the customer, any condition to the contrary will be unenforceable against Twisting Cat.

3. Products and availability

Products, such as the Twist model, are described as precisely as possible to inform the customer of their composition, mainly in compressed cardboard, with wooden front and back plates. If a product is unavailable after an order has been placed, the customer will be informed and may opt for a refund or a replacement product.

4. Ordering process

The order is considered firm after receipt of payment and confirmation by email. The information provided by the customer is his/her responsibility, particularly in the event of a data entry error, and Twisting Cat cannot be held responsible for any additional costs resulting from an error in the information provided.

5. Prices and payment terms

Prices are given in euros and include VAT for European Union countries. Delivery charges are added to the total when the order is placed. We accept credit cards, PayPal and bank transfers. In the event of late payment, interest of 12% per annum and compensation of 15% of the unpaid amount, with a minimum of €125, will be applied.

6. Delivery, Transfer of Risk and Claims

Products are shipped to the address provided by the customer. Delivery times are given as an indication, and Twisting Cat cannot be held responsible for delays due to carriers. Products travel at the customer’s risk as soon as they are handed over to the carrier.

For sales outside the European Union: customs duties, local taxes and any customs clearance fees are the responsibility of the customer. Twisting Cat cannot be held responsible for delays due to customs procedures. In the event of damage upon delivery, the customer must immediately inform the carrier and contact Twisting Cat within 5 days, providing photographic evidence.

7. Right of Withdrawal and Return of Products

In accordance with European regulations, the customer has a 14-day cooling-off period from receipt of the product. The product must be returned in its original, unused condition, and in its complete packaging. Return shipping costs are at the customer’s expense, except in the case of proven and validated defects on wooden plates.

8. Warranties and Maintenance Conditions

Twisting Cat offers a 2-year legal warranty of conformity for wooden structural elements (front and back plates), and a warranty against hidden defects, in compliance with Belgian and European legislation. However, compressed cardboard elements, intended to be scratched and worn, are not covered by this warranty.

Wooden elements: The front and rear wooden plates are guaranteed against manufacturing defects and hidden faults. In the event of a problem, the customer must contact customer service within 1 month of discovering the defect to report any problems with these components. Twisting Cat may choose to repair or replace the item concerned.
Cardboard surfaces: Wear due to scratching is considered normal for cardboard surfaces and is therefore not covered by the warranty. These surfaces can be replaced periodically, and cardboard refills are available for purchase.

The customer is responsible for routine maintenance, including replacement of worn scraping surfaces. Inappropriate use or insufficient maintenance are excluded from the warranty.

Note for international customers: For warranty claims on products shipped outside the European Union, additional delays may apply due to international logistics.

9. Reservation of title

Twisting Cat retains ownership of the products until full payment has been received. In the event of non-payment, the customer must return the products at the customer’s expense. In the event of seizure, the customer undertakes to immediately inform the authorities of Twisting Cat’s retention of title clause.

10. Liability

Twisting Cat accepts no liability for consequential damages or damages resulting from improper use of the products. Twisting Cat’s liability is strictly limited to proven defects and covers direct damage only.

11. Force Majeure

Twisting Cat cannot be held responsible in the event of non-performance of its obligations due to a case of force majeure (natural disaster, pandemic, strike, etc.).

For international shipments: in the event of disruptions such as border closures or suspension of postal services, Twisting Cat cannot be held responsible for delays or cancellation of delivery. Twisting Cat’s obligations will be suspended for the duration of the force majeure.

12. Intellectual Property

The Twisting Cat brand, logo, product models, images and photos displayed on the site are protected by intellectual property rights. They are the exclusive property of Renaud Glotz and Dorothée Cirichelli.

Prohibited use: Any reproduction, distribution, modification, unauthorized use, or extraction of our models, trademarks, images or photos, including use by artificial intelligence tools for image or model generation activities based on our designs, is strictly prohibited without prior written authorization.
Protection against automated reproduction and artificial intelligence: Twisting Cat’s trademark, logo, images and products are protected against any automated reproduction or extraction of data (data mining), machine learning or generation by artificial intelligence. Any infringement, including by AI, will be treated as a direct violation of Twisting Cat’s intellectual property, which may result in legal action and financial claims.
Proactive legal protection: Twisting Cat actively monitors the use of its images and products online. If unauthorized use is detected, Twisting Cat reserves the right to take immediate action, including legal action, and to claim damages.
Authorization request: For all requests for commercial or educational use, please contact Twisting Cat customer service to obtain prior authorization.

13. Personal Data and Confidentiality

Customer data is collected and processed in accordance with the RGPD for order processing. Customers can access, modify or delete their personal information upon request. See our Privacy Policy for more details.

14. Disputes, Applicable Law and Jurisdiction

These GTC are governed by Belgian law. In the event of a dispute, the parties shall endeavor to resolve their differences amicably. Failing this, the courts of Namur shall have sole jurisdiction.
